SEA&MILES GENERAL RULES AND CONDITIONS

Sea&Miles loyalty program (hereinafter referred as “Sea&Miles”) is a world of digital solutions and special advantages that IDO Istanbul Deniz Otobüsleri San. and Tic. A.Ş which is the address of a fast, comfortable and safe travel offers to its esteemed guests. Sea&Miles offers special campaigns on the contracted stores and suprise discounts and and a chance to save idopara for IDO inter-city trips (Fast ferries and se abus trips).IDO reserves the right to incorporate contracted brands into Sea&Miles and to ensure that idopara is acquired and spent through these brands. IDO reserves the right to regulate and alter Sea&Miles General Rules and Conditions without any liability and notice.

1. Membership

1.1. Members:

All natural persons can become individual Sea&Miles member.There is no age limit for individual membership.

1.2. Membership Channels:

1.2.1. Individual Membership:

Program membership; Membersip begins when the person who wants to become Sea&Miles member fills out the membership form on www.ido.com.tr and www.seaandmiles.com.tr through IDO mobile application and accept general rules and conditions. You can apply for pre-membership at the box office in our terminals while you purchase your ticket. Prospective members who have completed the mandatory entry fields in the application form, can become active member by confirming the Sea&Miles General Rules and Conditions by clicking on the link sent via personal SMS to your mobile phone within 30 days. Sea&Miles General Rules and Conditions are deemed to have been read,understood and accepted by the applicant with the application form being filled without requiring the applicant’s wet signature.

1.3. Termination of Membership:

Sea&Miles members can terminate their memberships anytime they want without complying with any period of notice by making application through the following channels:

• By applying by e-mail to info@ido.com.tr through the registered e-mail address in our system that is stated according to Membership/transport contract,

• * By applying by e-mail to info@ido.com.tr signed with secure electronic signature belonging to the member,IdoPara, saved in the account will be initialized if Sea&Miles membership is terminated with the demand of member by filling out Personal Data Protection application form on www.ido.com.tr ; applying with the notification through notary or with the registered e-mail address.

1.4. Validty of Sea&Miles records:

In accordance with the General Terms and Conditions, IDO is the sole authority in the management of Sea&Miles accounts, the calculation and investment of idoPara and use of the accounts.

2. idoPara

2.1. Calculation Unit:

Idopara is an award money that Sea&Miles members win from the IDO Inter-city (Fast Ferry and Sea Bus)trips. Idopara is loaded into the member account within a minumum of 24 hours from the time of the trip.

2.2. idoPara account:

There is a Sea&Miles member account for each member , which Idopara is saved. idoPara and Sea&Miles accounts cannot be transferred and combined with idoPara of other Sea&Miles members. Idopara is spent as described within Sea&Miles , cannot be converted into cash or its cash equivalent cannot be given. In case of the cancellation of Sea&Miles membership, Idopara saved in the account will not be returned and cannot be converted into cash. IDO reserves the right of disposition, of any kind, in terms of the utilization conditions of idoPara.If a notarized waiver showing the death certificate, the inheritance certificate and demonstrating the waive of other heirs of the member is submitted to IDO, idopara of the deceased person will be transferred to one of the beneficiaries of the member. The transferred idopara will be valid as of the date of the first acquisition.

3. Winning idoPara

Idopara amount in Sea&Miles membership account is determined according to the conditions of the program of event which makes you win idopara. Being the sole authority in terms of these conditions IDO can unilaterally change the acqusition and utilization conditions of idoPara .

3.1. Winning idoPara for individual memberships:

You can win idoPara from your IDO inter-city trips (Fast Ferry and Sea Bus). Idopara you have won will be saved in your individual membership account. You can only win idoPara on the tickets issued to your name, not on the total price of PNR.

To process your idoPara automatically on the account, you need to buy your ticket by signing into your account using your phone number and password on www.ido.com.tr and IDO Mobile Application and clicking on “Buy Ticket”.If you purchase your ticket at the box offices in IDO terminals, you should convey your phone number belonging to Sea&Miles membership to the attendant.

3.2. No idoPara will be received in the following cases:

You cannot win idoPara for the tickets that you have purchased using idoPara, for any type of membership. You cannot win Idopara from extra purcahased services. If your name, surname, Turkish identity number and phone number information on Sea&Miles membership do not match the information on the ticket, you cannot win idoPara.

Sea&Miles members can get idoPara only once at each purchase. In the event that the same membership information is used to buy tickets for multiple times, you can gain points with only one PNR. Duplicated PNR will not provide any points.

3.3. Processing the missing Idopara:

When the requests of processing idoPara retrospectively, transactions can be made only for up to 3 months after the Sea&Miles membership is activated. You can maket his transaction on www.ido.com.tr under the “Missing idoPara Processing” section on the account page of the member on IDO Mobile application.

3.4. Validity of idoPara:

idoPara is valid for 2 calendar years starting from the date on which it is activated.( for example: idoPara,won on 15.05.2018 will expire on 31.12.2020.) Idopara which is not used and fell due at the end of 2 calendar years will be deleted from the membership account.

3.5. idoPara account statement:

Extracts showing idoPara balances are sent to Sea&Miles members via e-mail at the end of each month. Members can instantly view their idoPara balances by signing their account on www.ido.com.tr. Members are obliged to notify IDO of any changes related to their personal information. IDO is not responsible for not being communicated of notifications and announcements since members do not update their personal information. IDO reserves the right to notify of any kind of information about Sea&Miles only via electronic media and not to make a notice in written format.

3.6. Assessing the objections and making corrections in the records:

IDO is the sole authority to evaluate the objections related to idoPara balance and to membership of Sea&Miles members and if decided that idoPara is incorrectly processed into the account of a member, IDO reserves the right to cancel the processed idoPara or to prevent process of idoPara.

4. Spending idoPara

Tickets purchased with idoPara in Sea&Miles are named as award tickets. Award ticket purchases with idoPara can be made on www.ido.com.tr via IDO Mobile app. Sea&Miles members can arrange an awards ticket for someone else using IdoPara in their accounts. You cannot win idoPara fort he trips made with award tickets. Idopara which is required to use award tickets should be active on the account of Sea&Miles member.Opportunities may be subject to restrictions set by IDO and IDO may make extra regulations and changes regarding the acquisition and use of certain awards.

5. Change and refund in award tickets

Tickets purchased with idoPara cannot be changed or refunded. If trips are cancelled by IDO, refund of idoPara to the Sea&Miles members who purchased their tickets by using idoPara are automatically performed. If a round-trip ticket is purchased, the cancellation of the departure trip does not necessarily mean the cancellation of the return trip. Return tickets can also be returned upon the request of Sea&Miles members. IDO reserves the right to make changes in the award ticket application.

6. Other Provisions

6.1. Personal Data Protection:

 1. General Information about The Law

Personal Data Protection Law no 6698 was enacted on March 24, 2016 and published in the Official Gazette dated April 7 2016 no 29677.According to the article 32 titled “Effectiveness” of Personal Data Protection Law no 6698 , this law’s 8th,9th,11th,13th,14th,15th,16th,17th ,18th articles entered into force after six months following the date of publication.The purpose of Personal Data Protection law no 6689 is to protect the fundamental rights and freedoms of persons, privacy of personal life in particular, while personal data are processed and to set forth obligations of natural and legal persons who process personal data and procedures and principles to comply with for the same.

2. Clarification from Data Supervisor

Data Supervisor, as Istanbul Deniz Otobüsleri San. and Tic A.Ş (“IDO”) may use your personal data according to the relevant regulation in accordance with Law on Protection of Personal Data numbered 6698.

3. How will your personal data be processed?

In accordance with Law on Protection of Personal Data numbered 6698, we, as Istanbul Deniz Otobüsleri San. and Tic A.Ş. (“IDO”) in the capacity of data supervisor,can carry out all kinds of proceedings that can be carried out on data such as obtaining,storing,keeping,changing,rearranging,explaining,transferring,taking over,making available,classifying or preventing the use of your personal data that you have shared with our company in a complete or partially automatic way or non-automatic means provided to be a part of any recording system.

4. How will your Personal Data be collected?

Your personal data may be collected verbally, in written or on the electronic environment through our corporate website, mobile site, mobile application, our call center,our ticket sales counters, our contracted agents, employees of our sales and marketing department, forms collected during costumer visits, digital marketing,agreements,applications,forms through offers or e-mail , SMS or other means during job applications, during signing employment agreement and/or information that you conveyed to us within working hours, and the cookies placed in your computer automatically when you visit our website.

5. What are the purposes and legal grounds for processing your Personal Data?

Your personal data to be collected may be used by IDO for the following purposes in accordance with fundamental principles stipulated by Law and the terms and aims regarding personal data processing as specified in 5th and 6th Articles of the Law:

* • Promoting the services provided by our Company, introducing members of loyalty program and increasing communication, being able to make customer satisfaction applications and notifications, understanding trends,improving image, carrying out marketing advertisements and promotion activities.

* • Fulfilling data storage,reporting and notification liabilities stipulated by judicial and administrative authorities.

* • Providing legal,technical and commercial-business security of the Company and of concerned people who are in business relation with the Company.

* • Carrying out necessary proceedings required by relevant business units for realizing commercial activities carried out by the Company, planning strategies and carrying out the business processes affiliated to it.

* • Planning and enforcing human resources policies and processes of the company

In line with aforementioned purposes and in accordance with Lawa on Protection of Personal Data numbered 6698 and relevant regulation, the person/organizations to which your personal data that you share with us might be transferred are our, as Istanbul Deniz Otobüsleri San. and Tic. A.Ş. direct/indirect local/foreign affiliated; our partners of us who fall within the scope of unincorporated associations, the organization that we cooperate with and that are partners of the program that we purchase services from in order to carry out our activities,local/foreign organizations and other third parties.

6. What are your rights as per Law on Protection of Personal Data numbered 6698 ?

a. Learn whether or not your personal data have been processed,

b. Request information as to processing if your data have been processed,

c. Learn the purpose of processing of the personal data and whether data are used in accordance with their purpose,

d. Know the third parties in the country or abroad to whom personal data have been transferred, 

e. Request rectification in case personal data are processed incompletely or inaccurately, 

f. Request deletion or destruction of personal data within the framework of the conditions set forth under article 7,

g. Reguest notification of the operations made as per indents (d) and (e) to third parties to whom personal data have been transferred,

h. Object to occurence of any result that is her/his detriment by means of analysis of personal data exclusively through automated systems,

i. Request compensation for the damages in case the person incurs damages due to unlawful processing of personal data.

1. 1. Individual Application:

Applicant should apply in person to the address of Kennedy Cad. Yenikapı Hızlı Feribot İskelesi 34480 Fatih / İstanbul with an official document indicating his/her identity.

Note: It should be written on the envelope as “Information claim within the scope of Law on Protection of Personal Data numbered 6698”.

1. 2. Notice through Notary Public:

Applicant should send a notice to the address of Kennedy Cad. Yenikapı Hızlı Feribot İskelesi 34480 Fatih / İstanbul through notary public.

Note: It should be written on the envelope as “Information claim within the scope of Law on Protection of Personal Data numbered 6698”.

1. 3. Application by means of Registered E-mail:

It is sufficient to send an e-mail to our company’s registered e mail of Şirketimizin ido@hs01.kep.tr with a subject of “6698 sayılı KVKK Kanunu Kapsamında Bilgi Talebi” (Information claim within the scope of Law on Protection of Personal Data numbered 6698).

Your applications will be concluded as soon as possible and no later than thirty days, depending on the nature of your claim; however, in the event of a separate cost accrual, Company’s right to demand price from you according to the tariff to be determined by Company’s Board of Personal Data Protection is reserved.

6.2. Misuse:

Members violating Sea&Miles General Rules and Conditions,abuse their rewards or attempt to gain an advantage, especially by giving false information about trip information may face some sanctions such as judicial penalty for such actions, payment of indemnity, termination of Sea&Miles membership by IDO, idoPara and/or their awards may be deemed invalid. IDO reserves the right to demand compensation the balance losses.

It will be assessed to be a fictitious transaction if the same membership information is used to buy tickets with multiple PNRs for the same trip.

6.3. Assignment of Sea&Miles:

IDO reserves the right to sell,license or otherwise assign to the associated companies of Sea&Miles, its affiliates,contractual brands and other group companies or third parties, and reserves the right of assignment the contracts made with members within this scope. Members will be informed about such a development fairly soon.

6.4. Termination of Sea&Miles Membership by IDO:

IDO may promptly terminate the contract with the member without any need of a period of notice provided that any of the following circumstances by reserving any right of compensation and litigation and in such a case, IDO cannot be held liable for IdoPara and other liabilities.

• When the member violates the Sea&Miles General Terms and Conditions,

• When the member violates the IDO Transport Rules,

• When the member gives wrong information to IDO in any issue,

• When confirmed that the applicant has benefited Sea&Miles in a manner contrary to the Sea&Miles General Rules and Conditions and the law,

• The presence of a verbal attack or assault,bullyinh or harassment against IDO employees or guests; violation of the instructions of the crew in charge,damage to the vessel or to the property of guests or crew.

Except the cases mentioned above, if Sea&Miles is suspended or abolished, Sea&Miles membership will be automatically terminated.Members can terminate their membership at any time and IDO can terminate the membership by notifying the relevant member in advance without stating any reasons. For reason a membership is terminated, members will not claim any right or receivable from IDO.

7. Applicable Law and Competent Court

The interpretation,practice and the resolution of the disputes of this Sea&Miles are subject to the laws of the Republic of Turkey and Istanbul courts and execution offices are authorized to settle the disputes. However, IDO reserves its right of litigation in other competent courts specified in the law.
